The Department of Justice, according to Republican congressman Adam Kinzinger, “will do the right thing” and file criminal charges against Donald Trump for his involvement in the attack on the US Capitol on January 6, 2021, he said in a Sunday interview.
“If this is not a crime, I don’t know what is. If a president can incite an insurrection and not be held accountable, then really there’s no limit to what a president can do or can’t do,” the Illinois lawmaker said.
“I think the Justice Department will do the right thing. I think he will be charged, and I frankly think he should be.”
“If he is not guilty of a crime, then I frankly fear for the future of this country.”

Kinzinger is a member of the House select committee that is looking into the attack, and it was decided last month to refer the former president to the justice department for questioning regarding allegations that he attempted to obstruct justice and conspired to defraud the US, made false statements, and “incited” or “assisted” an insurrection.
The recommendations are related to how the former US president encouraged the uprising at the US Capitol in Washington, DC, where tens of thousands of his extremist supporters attempted to block Congress from certifying Joe Biden’s victory over Trump in the 2020 presidential election.
The committee forwarded at least four criminal charges against Trump to the department: obstructing an official investigation, defrauding the US, making false statements, and aiding or abetting an insurrection.
The panel also stated in its executive summary that it had evidence supporting potential charges of seditious conspiracy and conspiring to harm or obstruct an officer.
In reality, the referral is merely a show of force. Although special counsel Jack Smith, who was chosen by attorney general Merrick Garland to look into Trump, has asked the select committee for evidence, it is not necessary for the Justice Department to take action.
